EPR Authorization Is Mandatory for All Companies Generating E-Waste

According to the E-Waste Management Regulations, the responsibility of disposing of or recycling e-waste in an eco-friendly manner is given to manufacturers and importers. This procedure is termed as EPR Authorization. EPR refers to Extended Producer Responsibility.

As per EPR, there are three different types of authorizations:

  • Manufacturing Authorization
  • Import Authorization
  • Wholesale Authorization

Among the three, the acquisition of manufacturing authorization is considered to be the most difficult one. Getting this authorization is required for any company (both Indian and foreign) that deals with electronic waste in any way. In case a company does not acquire the relevant authorization, it might be subjected to a penal imprisonment for a time period which can extend to five years, and/or a fine of one lakh rupees, depending on the applicable environmental laws, as stated in the provisions of the law.

EPR Certificate

A Better Way to Conserve Nature

The EPR Certificate is a document issued by the Central Pollution Control Board (CPCB) under the Ministry of Environment, Forest and Climate Change (MoEFCC), Government of India.

It was the Government of India, which, in 2011, laid the foundation for the first legal framework based on Extended Producer Responsibility (EPR), thus making manufacturers accountable for the management of the end-of-life stage of their products in an environmentally friendly way and ensuring proper disposal.

An Extended Producer Responsibility (EPR) Certificate or Authorization is necessary for each producer and importer of electrical and electronic equipment. The measure contributes to the production of sustainable and green products.

According to the CPCB norms, the manufacturers and importers are required to enter into an agreement with the authorised recyclers for the collection and disposal of the e-waste and submit the EPR implementation plans indicating the estimated quantity of e-waste generated and the proposed method of disposal. These plans must be given the green light by the CPCB in order to be issued the EPR Certificate.

Basically, the manufacturer of a particular product is the one that is accountable for its recycling, reuse, or safe disposal, thus making EPR a very important move towards a cleaner and more sustainable environment.

Document Requirements to Get an EPR Certificate

  • Certificate of Incorporation
  • PAN Details
  • Copy of Aadhaar Card (if applicable)
  • Product Details
  • (All the documents should be properly signed and stamped. The importer's name, product name, and model number should be correct to save time with the E-Waste authorities that may raise a query.)
  • Company Letterhead
  • Copy of IEC (for Importers only)
  • GSTIN Details

Steps to Get an EPR Certificate

The process includes the following steps:

  1. Gather all the documents that are necessary for the EPR Certificate.
  2. Create and sign a recycling contract between the producer/importer and a certified recycler.
  3. Deliver the EPR application and the supporting documents via the CPCB portal in an online mode.
  4. The CPCB examines the files and applications sent by the party.
  5. If necessary, the party must provide additional information or clarifications to the CPCB.
  6. Issue of the EPR certificate.

Timeline

  • Time required for the completion of the process: Around 60-70 days 

Note:

  • The recycling agreement is usually signed for a period of one year
  • The EPR Certificate is valid for five years and is subject to compliance with the CPCB ​‍​‌‍​‍‌​‍​‌‍​‍‌guidelines.
