Plastic Waste Approval | How to Get EPR Registration for Plastic Waste

India is one of the largest consumers of plastic products, with usage surpassing approximately 12 million tons annually. Plastics are widely used in applications such as shopping bags, tube lights, toys, furniture, and more. To mitigate this issue, the Central Pollution Control Board (CPCB) has introduced regulations requiring manufacturers using plastic materials in their products to obtain approval before market launch. Companies planning to distribute products across multiple states in India must comply with these CPCB regulations. According to the CPCB’s Standard Operating Procedure (SOP), manufacturers must establish a proper system for managing plastic usage and waste effectively.

This process involves registering with the CPCB and setting up a system to collect used plastic from distribution channels. Manufacturers generating plastic waste are required to segregate, store, and hand over the waste to authorized processing and disposal facilities. These measures aim to reduce the environmental harm caused by plastic waste. Failure to obtain plastic waste approval can lead to product launch restrictions or market withdrawal, making compliance crucial for sustainable business operations.

What is Plastic EPR?

EPR, or Extended Producer Responsibility, emphasizes the accountability of manufacturers and business owners for the proper collection, recycling, and disposal of products once they are no longer useful to consumers. The Indian Government introduced draft EPR Registration for Plastic Waste rules to ensure that businesses manage plastic waste responsibly, promoting recycling and environmentally sustainable disposal practices throughout the product lifecycle.

Why is getting plastic waste approval more essential than ever?

The draft EPR Certification rules apply to producers, importers, and brand owners planning to launch products in India. These regulations emphasize recycling and reusing plastic waste. Plastic materials that cannot be recycled, such as multilayered or multi-material plastics, must be sent for end-of-life processing, including applications like road construction or conversion to waste-to-oil. For manufacturers, obtaining plastic waste approval is essential to operate efficiently and compliantly in the Indian market.

Regulators require all manufacturers and importers to declare the quantity of plastic waste collected and the mechanisms used for collection. The government continuously updates strategies and enforces fines to curb plastic waste. By securing plastic waste approval, a business demonstrates its eligibility for lawful sale and distribution in India while showing a commitment to environmental responsibility through proper recycling and reuse practices.

Plastic Waste Management (PWM) Rules

The Extended Producer Responsibility (EPR) guidelines cover several types of entities responsible for the management and disposal of plastic waste. These include:
  • Producer (P): Responsible for the generation and management of plastic packaging used in their products.
  • Importer (I): Responsible for all imported plastic packaging and/or plastic packaging of imported products.
  • Brand Owners (BO): Including online platforms, marketplaces, and supermarkets or retail chains. Micro and small enterprises, as defined by the Ministry of Micro, Small and Medium Enterprises, Government of India, are excluded.
  • Plastic Waste Processors: Entities engaged in managing plastic waste through:
  • (a) Recycling
  • (b) Conversion of waste to energy
  • (c) Conversion of waste to oil
  • (d) Industrial composting
These provisions ensure that each stakeholder in the plastic lifecycle contributes to environmentally responsible management of plastic waste, from production and import to disposal and recycling.

Types of Plastic

The following plastic packaging categories are covered under Extended Producer Responsibility (EPR):

  • Category I – Rigid Plastic Packaging
  • Category II – Flexible plastic packaging of a single layer or multilayer (more than one layer with different types of plastic), plastic sheets or similar materials, covers made of plastic sheets, carry bags, plastic sachets, or pouches
  • Category III – Multilayered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic)
  • Category IV – Plastic sheets or similar used for packaging, as well as carry bags made of compostable plastics

The Extended Producer Responsibility Guidelines also address the following aspects regarding plastic packaging:

  • (i) Reuse
  • (ii) Recycling
  • (iii) Use of Recycled Plastic Content
  • (iv) End-of-Life Disposal

  • Registration certificate from the District Industries Centre of the State Government/UT, MSME, or Udyam Certificate
  • Scanned copy of authorized person’s signature
  • Copy of company letterhead
